New Fee for Trademark Applicants in Trademark Opposition Proceedings in Argentina: INPI’s Resolution 295/2024

New Fee for Trademark Applicants in Trademark Opposition Proceedings in Argentina: INPI’s Resolution 295/2024

Today, the Argentine National Industrial Property Institute (INPI) announced Resolution 295/2024, introducing a new fee in opposition procedures for trademarks in Argentina. Starting next week, applicants must pay a fee of ARS 8900 (about USD 9.61) in addition to responding to opponents’ arguments within a 15-working-day period. Failure to pay the fee will result in automatic rejection of the trademark application by the INPI.

The rationale behind this new fee is to address a backlog of maintained oppositions that have not been responded to by applicants, ensuring a clear interest in resolving oppositions. The resolution also includes a transitional clause for dormant applications with pending oppositions, prompting applicants to pay the fee or face rejection.

Key takeaways:

  • Respond and pay the fee for pending Argentine applications with oppositions to avoid rejection.
  • The new resolution offers a fresh chance to show interest in unresolved and unanswered oppositions by paying the fee.
