Good News on the Registration of Patents in Argentina

On May 3, 2019, the Argentine Patent Office provided through Resolution No. 112/2019, the creation of the Priority Patent Examination program (“Program”). The Program enables to have early access to substantive examination if certain conditions are met, such as that (i) the first regular filing of the patent application has been made in Argentina, and (ii) that the application has already been published in the Bulletin, among others.

The Resolution sets forth a three-year- period for the Program that could be extended for equal and successive periods. Considering that the practice has shown that the Program has led to a significant improvement in time efficiency with respect to study and applications resolution, the Argentine Patent Office, through Resolution 186/2021 issued on November 24, 2021, established the continuity of the Priority Examination Program on a permanent basis.
