The Undersecretariat for Consumer Protection and Commercial Loyalty has launched the National Registry of Offenders (RENAI), a tool that had been contemplated for decades but had never been fully operational.
It consists of a public, centralized, nationwide database that will compile administrative sanctions imposed on providers of goods and services across the country. It will include not only violations of the Consumer Protection Law, but also those related to fair trade practices and legal metrology.
In this way, RENAI transforms administrative sanctions into something more than a legal consequence: it turns them into publicly accessible data. In practical terms, this amounts to the creation of a “reputational record,” shifting the risk beyond the purely legal sphere or the monetary burden of the sanction itself. A violation published in an official registry may affect consumer perception, influence commercial decisions, and even impact due diligence processes.
Ultimately, each potential infringement must also be assessed in light of its impact on the organization’s image. In this new paradigm, adopting a comprehensive approach that combines regulation, technology, and reputational management becomes essential.
