INPI Resolution 162/2026 published on May 29, 2026, established a new Regulation for the Recordal of Assignments and Titleholders’ Changes of Name in trademarks, patents and industrial designs. The reform seeks to simplify procedures, modernize criteria and provide greater legal predictability to recordal operations before the Office.
Changes under Resolution 162/2026
One significant change is the flexibility of documentary requirements. INPI establishes that neither apostille nor consular legalization will be required for documents executed abroad, considerably simplifying international transactions. Likewise, the new regulations expressly seth forth that in the case of private instruments, only the assignor’s signature, and eventually that of the assignor’s spouse, must be certified, reflecting an administrative practice of the Instituto Nacional de la Propiedad Industrial under the previous regime.
The new regulation introduces express definitions for key concepts such as “assignment”, “change of name”, “assignor” and “assignee”, while also establishing who is entitled to request the recordal.
It also incorporates the principle of sworn declaration regarding all submitted documentation and expressly recognizes the supplementary application of the Argentine Civil and Commercial Code.
New rules for complex transactions
The new Regulation also introduces clearer rules for situations that in practice generated uncertainty or inconsistent criteria, such as transfers related to inheritance proceedings, trusts or non-traditional corporate structures.
Regarding procedural matters, the new regime reinforced control over the traceability of rights, limiting the benefit of an abbreviated chain of title filings: a single recordal will only be admitted if the successive transfers are unavoidably contained in the same act and instrument.
With respect to office actions, the INPI establishes an initial term of 10 business days to respond, automatically extendable for three additional consecutive periods of the same duration.
In this way, the new regime seeks to make procedures more predictable, simple and transparent for holders of industrial property rights.
