The Secretariat of Domestic Trade regulated the Gondolas Law with effects to ecommerce stores

The Gondola Law was regulated with effects for some ecommerce stores! As of 9/11/2021, Supermarkets; Superstores; Self-service stores; Retail chains; wholesalers and shopping centers will have to arrange their products online under the following criteria:

The recently published regulation, which will enter into force on 09/11/2021, provides criteria for the disposition of products at websites -in the virtual locations- of supermarkets; superstores; self-service stores; retail chains; wholesalers and shopping centers. Under this regulation it is provided that: 

  • Certain products must be displayed on the first access display, in order of appearance determined by the lowest price per unit of measure, under a principle of neutrality without promotional highlights or legends.
  • With respect to products whose list price is the lowest offered to the final consumer on a non-transitory basis, they shall be displayed with the clear and legible legend “MENOR PRECIO por unidad de medida. Ley 27.545.”
  • Regarding national products produced by: (i) micro and small enterprises; (ii) subjects of the family, peasant and indigenous agriculture sector; (iii) of the popular economy sectors, and/or (iv) those produced by cooperatives and/or mutual associations shall be displayed with the clear and legible legend “COMPRE MIPYME” in all cases.
